1.This Sweepstakes begins on July 22, 2020 on or after 9:00 a.m. Eastern Time (ET), depending on when the Sweepstakes message is posted, and ends at 8:59:59 a.m. (ET) on July 23, 2020. “Follow”  the official   OLD PARR Instagram page, @oldparr_us (http://www.instagram.com/oldparr_us) AND the official THE HUNGRY POST Instagram page,  @thehungrypost (www.instagram.com/thehungrypost), if you do not already.  As a requirement to follow @oldparr_us, you must first verify that you are of legal age to consume alcohol beverages as per Instagram’s functionality.

2. TO ENTER: like and then comment on the Sweepstakes message on the official THE HUNGRY POST Instagram page by tagging at least three (3) friends who you would like to attend the OLD PARR sponsored “THE HUNGRY POST  virtual house party” with you on Thursday July 30, 2020, all of whom meet all of the following criteria: (a) are 21 years of age or older; (b) are a legal resident of the United States and are not employees (or members of their families or households) of Diageo Americas, Inc., The Hungry Post, LLC, and (as applicable) their respective affiliates, printers, advertising and promotion agencies, alcohol beverage suppliers, importers, wholesalers, distributors or retailers; (c) are personally known to you and whom you believe are interested in OLD PARR blended scotch whisky, The Hungry Post restaurant recommendation platform, as well as the OLD PARR sponsored “THE HUNGRY POST virtual house party” and (d) have provided their consent in writing to you before being tagged in your comment.

BY POSTING A COMMENT, YOU REPRESENT AND WARRANT THAT EACH TAGGED FRIEND MEETS ALL OF THE PRECEDING CRITERIA.  WITHOUT LIMITING THE FOREGOING, ELIGIBLITY TO ENTER THE SWEEPSTAKES AND WIN A PRIZE IF SELECTED IN THE RANDOM DRAWING AS PER RULE 4 BELOW IS EXPRESSLY MADE CONTINGENT UPON AN INDIVIDUAL’S PROVISION OF ADEQUATE PROOF OF OBTAINING EACH TAGGED FRIEND’S CONSENT BEFOREHAND, AS DETERMINED IN THE SOLE DISCRETION OF SPONSOR AND THE HUNGRY POST, LLC (A THIRD PARTY, WHICH IS INDEPENDENT OF SPONSOR WHICH WILL IMPLEMENT THE SWEEPSTAKES). SHOULD AN INDIVIDUAL IMPROPERLY TAG A FRIEND, SPONSOR AND THE HUNGRY POST, LLC EACH EXPRESSLY RESERVE THE RIGHT TO PURSUE ALL AVAILABLE LEGAL REMEDIES AGAINST SUCH INDIVIDUAL IN ADDITION TO DISQUALIFYING HIM/HER FROM THE SWEEPSTAKES.  

You must be a registered member of Instagram in order to participate in the Sweepstakes and, if submitting an entry, to have a chance to win a prize in the Sweepstakes. Membership on Instagram is free, but a compatible mobile device is required to download the Instagram app and for optimal use of the Instagram service. If participating in the Sweepstakes by using the Instagram app or otherwise via mobile device (i.e., mobile version of the Instagram website), wireless Internet access and/or other fees may apply. Please consult your wireless service provider regarding your pricing plan.  Not all cellular phone providers carry necessary service to use a mobile device to enter the Sweepstakes.  Wireless Internet access is not available in all areas.

If a comment includes fewer than three (3) tagged friends who meet the criteria set forth above and are otherwise in compliance with these Official Rules (as applicable) such comment will NOT result in entry.

You may also include additional content as part of your comment regarding your interest in the OLD PARR sponsored  “THE HUNGRY POST virtual house party” but you are not required to do so to enter the Sweepstakes nor will doing so increase your chances of winning a prize in the Sweepstakes.  In such case:

Any content, material or information included in comment shall not be confidential, proprietary or trade secret. Prospective entrant represents and warrants that the comment is their sole, original work and that it does not infringe upon the rights of any other party, including but not limited to any intellectual property, trade secret or other proprietary rights of any other party.* No comment shall (a) reference persons consuming alcoholic beverages; (b) reference persons conducting themselves in an inappropriate manner; (c) contain material that would imply that the consumption of alcoholic beverages is acceptable before or while operating machinery, driving a vehicle or undertaking any other activity that requires a high degree of alertness or physical coordination; (d) contain any material that would degrade or demean the human form, image or status of women, men or the members of any group based on race, religion, ethnic background, sexual orientation or any other minority status; or (e) include a reference to any person who is or may be under 21 years of age (including but not limited to tagged friends).  Obscene, provocative, lewd or otherwise objectionable content or those which reflect poorly on the OLD PARR brand as well as content which is irrelevant to the theme of one’s interest in the upcoming OLD PARR sponsored  “THE HUNGRY POST“ virtual house party” are prohibited and will not result in Sweepstakes entry (even if person posting such comment is eligible for the Sweepstakes and otherwise fully complied with these Official Rules) and the determination of the appropriateness/relevance of any comment is at the sole discretion of  Sponsor and/or The Hungry Post, LLC. Should Sponsor or The Hungry Post, LLC identify any comments which are violative of the preceding requirements, Sponsor and/or The Hungry Post, LLC each reserve the right to petition Facebook, Inc./Instagram to remove such comments from the Instagram social media platform and to otherwise take any and all necessary and appropriate actions so as to protect their respective legal rights (this is in addition to the person posting such comment not being entered in the Sweepstakes).

*Prospective entrant further represents and warrants that his/her identification of tagged friends in his/her comment/entry was with the prior consent of each such tagged friend and that such identification therefore does not infringe upon the rights of any of the tagged friends.

ANY ADDITIONAL CONTENT INCLUDED IN A POSTED COMMENT REPRESENTS SOLELY THE VIEWS/OPINIONS OF THE PROSPECTIVE ENTRANT HIM/HERSELF AND DOES NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR OR THE HUNGRY POST, LLC IN ANY MANNER. SPONSOR AND THE HUNGRY POST, LLC WILL NOT REVIEW ANY SUCH ADDITIONAL CONTENT PRIOR TO THE POSTING OF SAME BY PROSPECTIVE ENTRANTS AND BOTH ENTITIES EXPRESSLY DISCLAIM ANY AND ALL LIABILITY IN CONJUNCTION THEREWITH.

One (1) entry per person. (However, a person who is a legal U.S. resident of Connecticut, Florida, New Jersey or New York State MAY enter the Sweepstakes as well as being the tagged friend of one [1] or more other entrants.) Commenting more than once, use of multiple Instagram accounts or any other method to violate the preceding entry limit will result in voiding of all entries made by such person with disqualification of such person. (However, such disqualification will not affect the eligibility of friends tagged in such person’s entry assuming that such tagged friends are (a) legal U.S. residents of Connecticut, Florida, New Jersey or New York State and (b) choose to enter the Sweepstakes themselves.) A given Instagram account may only be used by one (1) person to participate in the Sweepstakes as an entrant and/or a tagged friend.

Sponsor is not responsible for telephone or cell phone service disruptions or other equipment or service issues that might affect a person’s ability to access the official OLD PARR Instagram page and/or THE HUNGRY POST Instagram page and thereafter enter the Sweepstakes or the ability of the Sponsor to notify the winners. Sponsor assumes no responsibility for lost, late, damaged, misdirected, illegible, corrupted, jumbled, garbled, incomplete, inaccessible, incorrect entries or other Sweepstakes materials, all of which are void.    All entries become the property of the Sponsor and will not be returned. Any acknowledgment of receipt of entry, including any reply comment posted by The Hungry Post, LLC on its official Instagram page or any comment posted by Sponsor on the official OLD PARR Instagram page does not constitute any representation of eligibility for the Sweepstakes nor is it otherwise binding upon the Sponsor or The Hungry Post, LLC.

3. Prizes: (2) Grand Prizes will be awarded. A winner will receive an OLD PARR house party kit, including:

• 3-piece shaker branded with the OLD PARR logo
• Stirring spoon branded with the OLD PARR logo
• Two (2) highball cups branded with the OLD PARR logo
• Imported candies/snacks
• (2) THE HUNGRY POST caps

Alcohol beverages are NOT part of the prize.  With respect to the candies, Grand Prize winner understands and agrees that the candies may conflict with his/her dietary restrictions (for health, religious or other reasons) and/or may not be to his/her taste; and, in such case, Sponsor and The Hungry Post, LLC will not have any liability to the Grand Prize winner beyond award of the remaining elements of the OLD PARR house party kit. Each prize will only be shipped to a street address in Connecticut, Florida, New Jersey or New York State. (The tagged friends in the winner’s entry will not receive a matching prize.) Approximate Retail Value: $50 each. Total Approximate Retail Value of All Grand Prizes: $100.

4. Winner Determination: Winners will be selected in a random drawing on Friday, July 24, 2020 by The Hungry Post, LLC whose decisions will be final in all matters relating to this sweepstakes. If additional content is included in a comment/entry, the nature of such additional content will not be taken into account in the winner selection procedure provided that such additional content is in compliance with these Official Rules including Rule 2 above. Odds of winning will be determined by the total number of eligible entries received. The winners will be notified by direct message on July 24, 2020 beginning after 10:30 a.m. ET; BE SURE THAT YOUR INSTAGRAM SETTINGS ALLOW FOR @thehungrypost TO CONTACT YOU VIA DIRECT MESSAGE. Winners will be required to sign a declaration of eligibility, a liability release and a publicity release (where lawful) within five (5) days of notification or prize will be forfeited and may be awarded to another winner at Sponsor’s sole discretion. However, in order to assure receipt of the prize prior to the OLD PARR sponsored  “THE HUNGRY POST virtual house party” on July 30, 2020, the declaration must be returned within twenty-four (24) hours of notification.  (The declaration will include a statement that the winner obtained the written consent of each tagged friend prior to entry as well as otherwise fully complying with these Official Rules.) Winner agrees that an electronic signature/affirmation or facsimile version of the declaration shall have the same legal force and effect as a hand-signed document; but, should Sponsor and/or The Hungry Post, LLC determine in their sole discretion that the electronically signed/affirmed/facsimile version of the declaration is unreliable or unacceptable in any respect, award of the prize will be made contingent upon winner returning the original “hard copy” of the declaration bearing his/her actual physical signature.  If winner cannot be located or does not respond to attempt to be contacted within six (6) hours,  prize will automatically be forfeited and an alternate winner may be selected at Sponsor’s sole discretion. Except where prohibited, acceptance of prize constitutes winner’s consent to use of his/her name, likeness and biographical data for advertising and promotional purposes without additional compensation.

5. Eligibility: This Sweepstakes is open only to legal U.S. residents of Connecticut, Florida, New Jersey or New York State, who are 21 years of age or older at the time of entry. Void elsewhere and where prohibited or restricted by law. Employees of the following entities and members of their families or households are not eligible to enter the Sweepstakes under any circumstances: Diageo Americas, Inc., The Hungry Post, LLC , and (as applicable) their respective affiliates, printers, advertising and promotion agencies, alcohol beverage suppliers, importers, wholesalers, distributors or retailers. All federal, state and local laws apply.

6. General Conditions: Entry in the Sweepstakes constitutes one’s full and unconditional agreement to abide by and accept the terms and conditions of these Official Rules. No substitution of prize or cash equivalent except at Sponsor’s sole discretion.  Limit of one (1) prize per family, address or household. Actual prize (i.e., elements of the OLD PARR house party kit) may differ from depiction of same in the Sweepstakes message and other Sweepstakes advertising on the OLD PARR official Instagram page, The Hungry Post official Instagram page and/or elsewhere in terms of style, size or otherwise; and, Sponsor and The Hungry Post, LLC disclaim any and all liability in conjunction with any such difference.   Prize is non-transferable except at the sole discretion of the Sponsor. All federal, state and local taxes on the prize are winner’s sole responsibility.  By accepting the prize, winner waives the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize and any and all liability that might arise from redeeming or seeking to redeem said prize. Winner also accepts sole responsibility for any miscellaneous costs relating to acceptance of prize.

Entrants hereby agree to indemnify and hold Sponsor, The Hungry Post, LLC and Facebook, Inc./Instagram harmless from and against any third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses, including attorney fees and court costs, arising out of any breach or alleged breach of any of the warranties and representations set forth above. Sponsor makes no representation or warranty of any kind regarding any elements of the OLD PARR house party kit prize including but not limited to the warranty of merchantability or fitness for the intended purpose.

The value of the prize won by a participant under the sweepstakes may be taxable as income to its winner.  Winner is solely responsible for any and all taxes and/or fees associated with the prize. Upon receipt of a prize, the winner shall be required to comply with any and all applicable federal, state and local laws, rules and regulations.

In consideration of his/her receipt of any prize,  prize winner for himself or herself and his or her guest, heirs, personal representatives and assigns shall voluntarily and knowingly completely and forever release, waive and discharge Sponsor and all related parties, The Hungry Post, LLC, as well as Facebook, Inc./Instagram from and against any and every kind of claim, demand, injury, costs, attorney fees, right, liability or cause of action or other liabilities of whatever kind or nature, known or unknown, absolute or contingent, and whether or not fixed, which the prize winner ever had, now has or might in the future have arising in any way or related to this Sweepstakes, including, but not limited to, prize winner’s participation in the Sweepstakes; prize winner’s Sweepstakes entry; use of prize winner’s name, likeness, biographical information, signature, image or likeness; prize winner’s receipt, use or inability to use any prize or part thereof, including but not limited to injury or loss sustained in any travel related to the prize; financial claims; physical and/or emotional injury; and/or any other legal claim that may arise, whether under contract, tort, warranty or any other theory or claim.

Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the promotion at any time without notice or further obligation.

7. Electronic Entries: In the event of a dispute, on-line entries (including entries made via mobile device) will be deemed made by the authorized account holder of the e-mail address associated with the Instagram handle used to enter the Sweepstakes. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service, or other organization that is responsible for assigning e-mail addresses. Sponsor and its agencies (as well as The Hungry Post, LLC) are not responsible for lost, late, damaged, illegible, misdirected, or incomplete entries/comments, or for on-line entries/comments not received due to lost, failed, delayed or interrupted connections or miscommunications, or to other electronic malfunctions, delays, or errors of any kind in the transmission or receipt of entries/comments. (The preceding includes but is not limited to filtering or other operation of the functionality of Instagram.)  Sponsor and The Hungry Post, LLC are also not responsible for incorrect or inaccurate entry information, whether caused by Instagram users or by any human or technological error that may occur in the processing of entries/comments in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel or suspend all or a portion of the Sweepstakes, should viruses, bugs or other causes beyond control of the Sponsor or The Hungry Post, LLC corrupt the administration, security or proper operation of the Sweepstakes.
